Terms of Service
Last updated November 3, 2026
These terms are an agreement between you (the "Client" or "you") and Crosspoint Marketing, owned and operated by Wesley Rice in Amarillo, Texas ("Crosspoint," "we," "us"). By using our website, booking a call, or signing up for a plan, you agree to them.
1. Services
We design and host websites and set up lead automation, which can include a CRM account for your business, missed-call text-back, appointment reminders, review requests, AI chatbots and an AI phone receptionist, depending on your plan. The exact deliverables are in your proposal or order. A free homepage mock-up creates no obligation for either party.
2. Plans, setup fees and billing
| Plan | One-time setup | Monthly | Includes |
|---|---|---|---|
| Tier 1 (Starter) | $1,000 | $300/mo | Custom website and hosting, your own CRM, missed-call text-back, appointment reminders, Google review requests |
| Tier 2 (Growth) | $1,500 | $400/mo | Everything in Tier 1, plus AI chatbots on your website and social media that answer leads and book appointments |
| Tier 3 (Full Crew) | $2,000 | $500/mo | Everything in Tier 2, plus an AI phone receptionist that answers calls and books appointments |
- The setup fee is due before work begins and is non-refundable once work has started.
- Monthly fees are billed in advance, starting when your site or automations go live (or as stated in your order), and renew automatically each month.
- Prices exclude taxes and third-party costs you choose to add (such as domain registration, ad spend, or unusually high call or text volume). We'll tell you about any such cost before you incur it.
- If a payment fails and isn't fixed within 10 days of notice, we may pause the services until the account is current.
3. Minimum term and cancellation
- Every plan has a 3-month minimum term starting on the first monthly billing date. If you cancel during the minimum term, the remaining months of the minimum are still due.
- After the 3-month minimum, the plan continues month to month. You can cancel anytime by text, call or email with at least 30 days' notice. Service continues through the end of the paid period, with no further charges after that.
- Monthly fees already paid are not refunded for partial months.
- You can change plans after the minimum. Upgrades take effect on the next billing date, and an upgrade may carry the difference in setup fee.
4. Ownership and what happens when you leave
You own your business name, logo, photos, text you provide, your domain and your CRM data. When you've paid in full, you own the final design of your website's content. Our underlying code, templates, automations and the hosting platform remain ours or our providers'. If you cancel, we'll export your CRM contacts and provide your site content on request; moving the site to another host may need a rebuild and isn't included.
5. Your responsibilities
- Give us accurate information and timely feedback and content.
- Have the rights to everything you give us to use.
- Use the CRM and messaging lawfully. You're responsible for getting proper consent from your contacts (including under the TCPA and A2P 10DLC carrier rules), honoring opt-outs, and the content of messages you send or approve.
6. SMS terms
When you opt in to texts from Crosspoint, you'll receive messages about your request and appointments and, only if you opted in to marketing, occasional offers. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out at any time; reply HELP for help, or call 806-268-9790. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase. We don't share mobile numbers or opt-in data with third parties for marketing. See our Privacy Policy.
7. AI features
AI chatbots and the AI receptionist can make mistakes. Review their settings and answers, and don't rely on them for emergencies, legal, medical or financial advice. We'll fix configuration issues you report promptly.
8. Third-party services and results
Our services rely on third parties (hosting, CRM, phone carriers, Google, Meta and others), and we're not responsible for their outages or policy changes. We work to get you more calls and booked jobs but don't guarantee specific rankings, lead volume or revenue.
9. Limitation of liability
To the fullest extent allowed by law, our total liability for any claim is limited to the fees you paid us in the 3 months before the claim, and neither party is liable for indirect, incidental or lost-profit damages.
10. Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be handled in the courts of Potter County, Texas, unless we agree otherwise.
11. Changes
We may update these terms. We'll change the date above and give notice of material changes. Continued service after notice means you accept the update.
